Supreme Court school admissions case targets Maryland magnet schools

The Supreme Court school admissions docket gained a new case on Monday. The justices agreed to hear a challenge to how four magnet schools in Montgomery County, Maryland, choose students.

The challengers are parents organised as the Association for Education Fairness. They say the district’s “Pandemic Plan” discriminates against Asian-American students in favour of Black and Latino students.

How the process works

The district first screens students for academic potential. It then uses a lottery to select who gets enriched instruction at a magnet school. The parents argue the screening makes it harder for Asian-American students to reach the lottery pool. They also object to a ranking that compares scores with those of students from similar income backgrounds.

The policy does not mention race. That matters for the legal fight.

What the justices will weigh

A federal district judge, Paula Xinis, dismissed the case in 2022. She noted that the share of admitted Asian-American students exceeded their share of applicants. She found no evidence of discriminatory intent in the lottery policy.

The Supreme Court will now consider two questions. First, whether the group has enough evidence of discrimination for the case to proceed. Second, whether a group harmed by a race-neutral policy must show disproportionate harm to prove intentional discrimination.

Arguments are expected in the coming months. A ruling should arrive by June.

Why it matters beyond Maryland

Many districts use lotteries, screening tools and income-based comparisons to widen access. A ruling for the parents could force changes to those systems. A ruling for the district could confirm that race-neutral tools survive scrutiny without proof of intent.

Courts and governments are already testing how far state power can stretch in other areas. See our opinion piece on the denaturalization drive.

The facts of the case have not been tested at trial. The parents’ claims are allegations.

Montgomery County is a suburb of Washington, DC. Its magnet schools are academically rigorous and highly sought after. Families on all sides will follow the argument closely.
